Terms of Service
These terms preserve the scope and information published on the current NursingHomeSurveys.com website.
By using, accessing or viewing Care Analytics websites, content, functionality and services—including web-based applications—the user accepts these Terms of Service. A user who does not agree must exit the website.
Scope of agreement
Care Analytics may change these terms periodically. Users are bound by the posted version and should check periodically for updates. Continued use after revised terms are posted constitutes acceptance. Questions may be sent to legal@careanalytics.net.
License and website access
Care Analytics grants each user a personal, non-exclusive, non-transferable and revocable license to access and view the website, forums and internet material. The license may not be assigned or sublicensed.
The website may contain public and restricted areas. Authorization to view one area does not create access rights to another. Restricted areas may require account creation and login. Users are responsible for safeguarding usernames and passwords and for activity under their accounts, and must report unauthorized use or a security breach. Care Analytics may disable credentials when terms are not followed.
Care Analytics may monitor and record site activity and may disclose records, electronic communications or other content when required by law, necessary to operate the site, or needed to protect Care Analytics, users or business partners. Information may be stored or copied in reasonable quantities for valid business purposes, and users are responsible for misuse or improper disclosure.
Prohibited uses
The website may be used only for lawful purposes. Prohibited activity includes:
- Violating federal, state, local or international law or regulation, including export laws.
- Selling, distributing or commercially exploiting website content.
- Data mining, extraction, web bots, web crawlers or automated data gathering beyond a contractual relationship.
- Decompiling or recompiling data.
- Selling, renting, leasing, lending or transferring services or content.
- Disrupting the site or using it outside its primary purpose.
- Introducing viruses, Trojan horses, worms, logic bombs or other harmful material.
- Methodical attempts to access restricted content.
Links to third-party websites
Care Analytics websites may link to domains outside Care Analytics control. Links are provided for convenience. Care Analytics is not responsible for third-party content, resources or resulting harm, and does not guarantee or endorse a linked website. Users access third-party sites at their own risk and under the third party’s terms.
Disclaimer and warranty
Website information is provided “as is.” Care Analytics disclaims express and implied representations and warranties, including accuracy, completeness, non-infringement, availability and suitability. Each user is responsible for use of the content. Care Analytics is not responsible for third-party content or linked websites.
Privacy policy
Care Analytics intends to protect user information. The Privacy Policy should be read with these terms. By using the website, users are deemed to accept the privacy practices. Care Analytics collects and processes personal data only as appropriate to provide requested services.
Except as required by law, Care Analytics does not sell, lease or release names, addresses, phone numbers, email addresses or other personal data without consent and does not contribute to cooperative databases that give other companies access to that information. Industry-standard safeguards, including encryption and firewalls, may be used. Care Analytics websites collect information that clients and visitors knowingly provide. Information voluntarily shared in public forums becomes public. Marketing email recipients may unsubscribe using the link provided.
Intellectual property protection
Care Analytics reserves copyright, trademark, trade dress, patent, trade-secret and other protections for proprietary material. Website content—including software, compilations, search functions, photographs, graphics, logos, text, buttons, page layouts, audio and video—is owned by Care Analytics and protected by applicable law.
Users may access website material for legitimate business purposes related to their role as a current or prospective customer, supplier or distributor. Unless expressly permitted, users may not copy, modify, create derivative works, display, perform, republish, download, store or transmit website material. Unauthorized use may terminate the right of access and require copies to be returned or destroyed. Requests may be sent to legal@careanalytics.net.
Care Analytics community
Community message boards, forums and other interactive features may allow user contributions. Users retain responsibility for the legality, reliability, accuracy and appropriateness of what they submit. User opinions do not necessarily reflect Care Analytics.
Posted contributions are treated as non-confidential and non-proprietary, and Care Analytics may use, copy, distribute or disclose them. Care Analytics has no legal duty to monitor community content but may moderate it. Community rules include:
- Follow the established topic structure and place new threads in the appropriate area.
- Keep posts relevant; spam and commercial lead generation are prohibited.
- Remain respectful; racist, profane, obscene or inflammatory statements may be removed.
- Understand that the forum is public and posts may be reused, reproduced, published, retained or transmitted.
- No compensation is owed for use of posted content.
- Community posts are not medical or legal advice; users must consult qualified representatives.
Moderators may alter or remove content and restrict or terminate privileges. Illegal conduct may be reported to authorities. Questions may be sent to legal@careanalytics.net or community@careanalytics.net.
Contractually related parties
A party with an independent contractual relationship with Care Analytics is treated as a client. These website terms do not override other contractual arrangements and govern only where applicable.
Client-specific reports and analyses created under contract are the client’s property when obtained through a secure login and clearly designated for that client. Care Analytics retains ownership of the Care Analytics Knowledge Base, including questions, methods, protocols, comparative and benchmark databases, software, documentation and survey scores.
Care Analytics may receive limited access to respondent information owned by the client. Data stripped of identifying indicators as specified by HIPAA and incorporated into comparative or benchmark databases becomes part of the Care Analytics Knowledge Base. The client receives a non-exclusive, non-transferable license to use that knowledge base within the contracted relationship.
Client data files may be used internally and shared only with employees or contracted parties for analysis of the client’s own performance. They may not be used to generate outside benchmarks or shared with competing satisfaction, experience or engagement measurement services. The client is responsible for obtaining necessary consents for satisfaction, informational and other surveys.
Governing law and jurisdiction
These terms and related disputes are governed by the laws of the State of Indiana, without regard to conflict-of-law provisions. Federal law applies where appropriate. The terms do not require conduct contrary to the domestic law of a country in which the website is used.
